This is a Federal Register notice announcing that Cooperativa de Farmacias Puertorriqueñas (Coopharma), a Puerto Rico pharmacy cooperative, has petitioned the Federal Trade Commission to reopen and set aside or modify the FTC consent order entered November 6, 2012 (Docket No. C-4374), which barred Coopharma from collectively negotiating contracts with insurers and pharmacy benefit managers. Coopharma argues that Puerto Rico's enactment of Act 228 in 2015, combined with COSSEC's Regulation No. 9161 providing active state oversight of cooperative negotiations, constitutes a significant change in law that renders the order unnecessary and inequitable. The FTC is soliciting public comments due by October 15, 2024. This is not a NEPA document.1
