The U.S. Fish and Wildlife Service is accepting public comment on an application from Edward Rose and Sons (Eloah Estates) for a 5-year incidental take permit under ESA Section 10(a)(1)(B) to authorize take of the federally threatened Florida scrub-jay incidental to construction of a multi-family apartment complex on 46.61 acres in Volusia County, Florida. Approximately 7.25 acres of occupied scrub-jay habitat would be converted. The Service preliminarily determined the action qualifies as low-effect and may be categorically excluded from further NEPA analysis. Mitigation is a $222,241.50 contribution to the Florida Scrub-jay Conservation Fund prior to any clearing.
