This is a Notice of Availability for guidance issued by the Council on Environmental Quality (CEQ) on January 21, 2026, titled Guidance on Emergencies and the National Environmental Policy Act. The memorandum, addressed to heads of federal departments and agencies, rescinds and replaces prior CEQ emergency NEPA guidance published December 30, 2024 (89 FR 106448). It addresses how agencies should develop alternative arrangements when emergency actions are likely to have significant effects requiring an EIS, and how to apply EAs or categorical exclusions when effects are unlikely to be significant. The guidance does not create legal rights or establish new policy requirements.12
