The U.S. Army Corps of Engineers, Sacramento District is withdrawing its March 17, 2023 Notice of Intent to prepare an EIS for the Kennecott Tailings Impoundment Expansion Project in Salt Lake County, Utah. Following the Supreme Court's decision in Sackett v. EPA and the resulting Conforming Rule amending the definition of waters of the United States, the Corps re-evaluated the project and determined that the proposed action would result in only a minor discharge of fill material in jurisdictional wetlands. An EIS is no longer warranted, and the EIS process is terminated.12
