The U.S. Department of Energy Office of Environmental Management issued this Record of Decision on November 21, 2024, selecting Waste Control Specialists, LLC (WCS) near Andrews, Texas, as the Long-Term Elemental Mercury Management and Storage Facility (LTEMSF) under the Mercury Export Ban Act of 2008. The decision is supported by the Mercury Storage SEIS-II (DOE/EIS-0423-S2), which evaluated up to 7,000 metric tons of elemental mercury storage at eight existing facilities across seven states. WCS was chosen over alternatives including the Hawthorne Army Depot and other commercial sites because it can accept mercury expeditiously, carries lower environmental impacts, and minimizes DOE's statutory financial liabilities from the missed January 1, 2019 operational deadline. DOE still must issue a fee rule before physically accepting mercury.1
