This is a notice of availability and request for comments on a revised DOT Order 5610.1C, 'Procedures for Considering Environmental Impacts,' which updates DOT's internal NEPA implementing procedures for the first time since 1985. The revision responds to the rescission of CEQ's NEPA regulations under Executive Order 14154, the Fiscal Responsibility Act of 2023 amendments to NEPA, and the Supreme Court's May 2025 decision in Seven County Infrastructure Coalition v. Eagle County. The Order is effective immediately upon Federal Register publication but remains open for public comment through August 4, 2025. It consolidates NEPA procedures for several DOT Operating Administrations and cancels several predecessor orders.12
