The Consumer Financial Protection Bureau (CFPB) issued an Environmental Assessment and Finding of No Significant Impact (FONSI) for its final rule implementing consumer protections for residential Property Assessed Clean Energy (PACE) financing under EGRRCPA Section 307. The rule requires lenders to assess borrowers' ability to repay PACE loans and amends Regulation Z. The CFPB analyzed two alternatives: the proposed rule and no action. It concluded that while the rule may reduce PACE loan originations and thereby reduce some environmental benefits (solar capacity, greenhouse gas reductions, energy and water savings), those reductions represent a tiny fraction of national and state-level consumption and emissions, and no significant environmental impact will result.12
