Third Party Contracting Guidance

This notice announces the availability of FTA Circular C 4220.1G, the updated Third-Party Contracting Guidance, which supersedes C 4220.1F. The Federal Transit Administration received comments from 27 commenters after publishing the proposed circular on November 27, 2024, and the comment period closed December 27, 2024. The final circular incorporates statutory and regulatory changes including the Infrastructure Investment and Jobs Act, updated OMB Uniform Administrative Requirements at 2 CFR part 200, and revised DBE regulations. This is a procurement guidance document, not a NEPA environmental review, and contains no environmental impact analysis.

Notice of Availability of Proposed Circular Updates and Request for Comments

This is not a NEPA document. The Federal Transit Administration published a notice of availability of a proposed update to its Third Party Contracting Guidance Circular (C 4220.1F, last revised March 18, 2013), which governs procurements financed with FTA grants or cooperative agreements. The proposed circular (to be designated C 4220.1G) updates definitions, incorporates statutory changes from the IIJA and FAST Act, adds guidance on alternative contracting methods and data rights, and eliminates the current Chapter VII on protests. Public comments are due December 27, 2024. No environmental impacts are analyzed; this is a procurement policy document with no NEPA content.
