The National Park Service issued a Finding of No Significant Impact (FONSI) for a programmatic environmental assessment (PEA) evaluating e-bike use across all National Park System units. The PEA was prepared following a 2022 U.S. District Court ruling that NPS had improperly relied on a categorical exclusion for its December 2020 e-bike rule. Two alternatives were analyzed: a no-action alternative (no nationwide e-bike policy) and the proposed action (the existing rule), which defines e-bikes uniformly and gives superintendents discretion to allow e-bike use where traditional bicycles are permitted. NPS selected the proposed action and determined no significant impacts to soils, vegetation, visitor experience, or wildlife would result.12
