The U.S. Fish and Wildlife Service published a notice of availability in the Federal Register on May 4, 2026, for a draft Habitat Conservation Plan and draft Environmental Assessment related to an incidental take permit application from CalPortland Company. The permit would authorize take of the federally threatened desert tortoise (Gopherus agassizii) incidental to continued vested mining and cement manufacturing activities at CalPortland's Oro Grande Quarries and Cement Plant in San Bernardino County, California. To minimize take, CalPortland proposes using authorized biologists to translocate desert tortoises offsite, and to mitigate impacts by purchasing credits from an approved desert tortoise conservation bank. The draft EA evaluates the proposed permit issuance and a no-action alternative. The public comment period runs through June 3, 2026.123
