About the EA

Practitioner FAQ

When is an EA required instead of an EIS?

An EA is used when significant effects are uncertain. If the EA finds no significant impact, the agency issues a FONSI. If significant effects are likely, the agency must proceed to a full EIS.

Do Environmental Assessments require public comment?

Comment is not strictly required by the CEQ regulations, but most agencies invite comment voluntarily, particularly for EAs on visible projects. The 2023 NEPA amendments encourage comment where practicable.

How long is a typical Environmental Assessment?

EAs are statutorily capped at 75 pages and most run 50 to 100 pages including appendices. They are substantially shorter than the 300-plus-page typical EIS.
